Please read these Terms of Use ("Terms," "Terms of Use") carefully before using the http://loyalnsave.com website (the "Service," "site," "website") or Loyal~n~Save app (the "app") operated by LNS Solutions, LLC doing business as Loyal~n~Save ("us," "we," or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all members ("visitors," "users," or "you") who access or use the Service.

By visiting our site and/ or purchasing something from us, you engage in our "Service” and agree to be bound by the following terms and conditions ("Terms of Service”, "Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please note that each individual store may upload their own Terms of Service and policies, and by participating in that store's rewards, you agree to be bound by their Terms.

Please read these Terms of Service carefully before accessing or using the Loyal~n~Save website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to Loyal~n~Save participating stores shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to the Loyal~n~Save website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1. The Loyal~n~Save Service

The Loyal~n~Save Service (www.loyalnsave.com including the Loyal~n~Save app) provides members with the opportunity to enroll and participate in one or more loyalty programs and access special offers, coupons, discounts, and promotions from third-party merchants.

Through the Loyal~n~Save website, and/or app users who log in will be directed to a separate cloud-based platform where you may view available discounts at participating merchants, track your spending, view your rewards activity, and redeem points for rewards. All participation and use of the service is strictly voluntary and may be terminated at any time by the user, Loyal~n~Save, or one of its participating merchants for any reason.

Loyal~n~Save is NOT responsible for the participating merchants' Terms of Service, policies, loyalty campaigns, items available for point accumulation, point restrictions, Affiliate Team Reward point percentages and/or availability, point conversions or redemptions, or disputes arising therefrom.

2. Eligibility

By using the Service, you affirm that you are at least 13 years of age or older. You further affirm that any and all information you provide on the Loyal~n~Save website (www.loyalnsave.com) or app is true and accurate and does not infringe upon the rights of any person or corporate entity, nor does it violate any local, state, or federal laws.

The Service is provided for your personal use, and not for commercial use or for the benefit of any third party. Rewards and offers may not be sold, transferred, or used by a party other than the individual identified on the Loyal~n~Save account. It is your sole responsibility to ensure that you are in full compliance with all the terms and conditions set forth in the Loyal~n~Save Terms of Use.

Loyal~n~Save reserves the right to refuse service in our sole discretion and without notice. You are solely responsible for your use of the site and you agree to compensate, hold harmless, and defend us from any claims, damages, losses, liabilities, costs, and expenses including attorney's fees, resulting from your use or misuse of the website. Posting or transmitting any unlawful, infringing, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic, or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liberty, or otherwise violate any law, is strictly prohibited.

3. Registration & Use of Personal Information

Your use of this site is also subject to the terms of our Privacy Policy. You hereby acknowledge that you have read and understood our Privacy Policy, and consent to the use of any personal information that you provide in accordance with the terms of, and for the purpose set forth in, our Privacy Policy.

In order to use this Service, you must register your account with your personally identifying information, which may include but is not limited to first and last name, license number, address, and cell phone number. Any personal identifying information which you supply through the Service that would readily identify you as the user of this Service is done under your sole discretion.

Your personal information may be used by third-party merchants to send you promotions, text messages, reward points, coupons or other rewards. Additionally, your purchase information including merchandise, dates, and purchase amounts may be transmitted via the service to the third-party merchants for which you have subscribed to their loyalty program.

4. Merchant Loyalty Programs

Any loyalty programs and/or campaigns hosted on the Loyal~n~Save website are run independently of the Loyal~n~Save platform. Therefore, by accepting these Terms of Use, you affirm that Loyal~n~Save incurs no responsibility or liability for the earning or distribution of member rewards through the loyalnsave.com website or Loyal~n~Save app.

Please carefully read the Terms and Conditions set forth by each merchant whose loyalty program you participate in. It is your sole responsibility to ensure that you are in compliance with the Terms of Use for Loyal~n~Save, as well as any third-party merchants whose loyalty programs you choose to participate in.

5. Rewards & Redemptions

All loyalty reward points, percentages, cash vs. credit rates, team reward tiers, redemption rates, coupons, rewards, and point or coupon expiration dates are appointed and administered solely by the third-party merchants themselves. The Service makes no warranties as to the implementation of the third-party merchant loyalty programs that are hosted by the Loyal~n~Save website (www.loyalnsave.com) or app. Any and all questions, complaints, or disputes must be taken directly to the merchant in question. All reward points, coupons, discounts, or any other benefits cannot be transferred, have no cash value, and cannot be redeemed for cash. Depending on the Merchant, according to Federal law, no discounts, coupons, or points can be given on cigarettes, smokeless tobacco, or lottery tickets.

Certain products or services may be available exclusively online through a store’s Swag Shop. These products and/ or services may have limited quantities and may be subject to modification, price change, suspension, or discontinuance. Each participating store will have its own online Swag Shop and Loyal~n~Save is not responsible for the sale, redemption, or availability of items offered. No returns or exchanges may be made for items purchased in the Swag Store unless specified otherwise by the participating merchant. In that case, you must contact the merchant directly for issues regarding return/exchange. No points can or will be awarded for a return or exchange. If you encounter an issue with the online Swag Shop, please direct your concerns to that store individually.

6. Intellectual Property

All photos, logos, content, as well as any software applications including proprietary algorithms contained within the Loyal~n~Save website (www.loyalnsave.com) and app, are the sole intellectual property of LNS Solutions, LLC. Any attempt to copy, distribute, sell, or make any adaptations of the intellectual property of LNS Solutions, LLC without express written consent is strictly prohibited and constitutes copyright infringement and legal action may be taken against you.

Likewise, the logos, photos, and content provided by the merchants on their respective loyalty pages are copyrighted to them and used by Loyal~n~Save with their express permission upon entering into a contract with Loyal~n~Save to use our platform. Any misuse or infringement of their copyrighted material is punishable by law.

7. Opt-ins

By voluntarily supplying your cell phone number and/ or email, either directly to a third-party merchant or through the Loyal~n~Save website (www.loyalnsave.com) or app, you agree to receive SMS text messages, as well as push notifications of discounts, coupons, point notifications from Loyal~n~Save and third-party merchants you have signed up with. You also agree to the double opt-in for email communication. If at any time you wish to discontinue receiving text messages, push notifications, or emails, you may remove your contact information from your member page.

8. Third-Party Websites

Through the Loyal~n~Save website (www.loyalnsave.com) and app, you may encounter ads containing links or other links to third-party websites. If you click on one of these links you will be directed to that website. Loyal~n~Save does not own or operate these sites.

We provide these links as a convenience only. Loyal~n~Save does not publicly endorse these sites nor does it make any warranty of products or services available on these websites. Loyal~n~Save and all of its subsidiaries shall be held free and harmless from any content, transactions, or actions you take on a third-party site.

9. Site Warranty Disclaimer

The Loyal~n~Save website and its contents are provided "as is" and "as available" with no warranty of any kind. To the fullest extent permissible under applicable law, we expressly disclaim all warranties, both express or implied, including without limitations the warranties of merchantability, fitness for a particular purpose, and noninfringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade. We make no representation or warranty whatsoever regarding the completeness, accuracy, correctness, integrity, reliability, currency, adequacy, suitability, functionality, availability, or operation of this site or the content or services provided on, or accessible from this site. We do not guarantee that the operation of this site will be uninterrupted or error-free, or that this site is free from viruses and other harmful components to equipment or software.

10. Indemnification

In no event will we be liable, nor do we assume responsibility for any direct, indirect, special, incidental or consequential damages arising out of or in connection with the use or inability to use this site or the content or services provided on, or accessible from this site, or otherwise even if we are advised of the possibility of such damages.

You further agree to hold harmless of any liability all of Loyal~n~Save's subsidiary companies, affiliates, employees, officers, directors, suppliers, contractors, agents and successors from all liabilities, claims, and expenses, including reasonable attorneys' fees which are brought by a third party, that arise from or relate to your use, misuse of or access to Loyal~n~Save (www.loyalnsave.com), Loyal~n~Save content, member content, violation of Terms of Use for Loyal~n~Save, as well as any third-party merchant loyalty service contained within the Loyal~n~Save website.

Loyal~n~Save and its subsidiaries will not be held liable for the quality, performance, or results of any loyalty campaign housed on the Loyal~n~Save platform. By agreeing to these Terms of Use, you agree to indemnify and hold harmless Loyal~n~Save from all liabilities, lawsuits, claims or demands (including the reasonable costs, expenses, and attorney fees on account thereof) that may be made a third party when such claim arises out of any use of the service for which it is not intended by the user.

11. Laws and Regulations

User access to and use of Loyal~n~Save (www.loyalnsave.com) is subject to all international, federal, state, and local laws and regulations. You agree to abide by all laws in connection with this service.

12. Website Security

While Loyal~n~Save will take preemptive measures to protect the privacy of its users and their personal information, the absolute security of any site on the internet cannot be guaranteed. Access to and the use of password protected and/or secure areas of the Loyal~n~Save website is restricted to authorized users only.

Unauthorized individuals attempting to access these areas of the site may be subject to prosecution. Users are encouraged to choose secure passwords that are not known to other people or used for other websites. If you share your login credentials with anyone else, Loyal~n~Save is not liable for the use or misuse of any of your personal information.

13. Use of Cookies

If you do not wish to have cookies stored on your machine, you can turn cookies off in your browser. You will still have access to all information and resources on the Loyal~n~Save website. However, turning off cookies may affect the functioning of some websites. Be aware that disabling cookies in your browser will affect cookie usage at all other websites you visit.

14. Affiliate Team Rewards Exceptions

Each merchant on the Loyal~n~Save platform is solely responsible for the administration and redemption of all Team Reward points. Team Rewards are bonus points awarded based on a percentage of points earned by team members by shopping in-store and assigned according to the tier level of those Loyal~n~Save members signed up underneath them.

I. ELIGIBILITY

Affiliate Team Reward points may be awarded on the basis of transaction type. It is at the sole discretion of each individual merchant whether they wish to assign Team Rewards for purchases made with cash and debit or credit cards or cash only purchases. Any questions about Team Rewards eligibility should be reviewed through each Merchant’s Terms and Conditions.

By agreeing to these Terms, you hereby acknowledge that it is your sole responsibility to direct any questions, complaints, or suggestions with each individual merchant. You further acknowledge that Loyal~n~Save makes no warranties, promises, or guarantees to the decisions of the merchants in the running of their loyalty programs including their use of Team Rewards.

II. INACTIVITY AND DEACTIVATION

If you have not shopped in a store you are registered with for 4 months (120 days from the date of your last purchase), your account will be placed on hold and you will stop accruing points from your team members. To reactivate your account at that store, simply make a purchase and you will continue earning points.

III. FORFEITURE OF TEAM REWARD POINTS

Should your account become inactive after 4 months (120 days since your last purchase), you will cease to accrue Team Reward points from the team members that are signed up underneath you. The points that would have been awarded to you, will instead be awarded to the team member directly above you until the time when your account has been reactivated by shopping in that store. In the event that there is nobody signed up above you in your team, then your points would simply be forfeited.

15. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. New changes will be posted to the Loyal~n~Save website (www.loyalnsave.com). What constitutes a material change will be determined at our sole discretion. It is your responsibility to check these Terms for any changes or updates that may have occurred.

16. Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

(a) for any unlawful purpose;

(b) to solicit others to perform or participate in any unlawful acts;

(c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

(f) to submit false or misleading information;

(g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;

(h) to collect or track the personal information of others;

(i) to spam, phish, pharm, pretext, spider, crawl, or scrape;

(j) for any obscene or immoral purpose; or

(k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

We reserve the right to terminate your use of the Service or website for violating any of the prohibited uses. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

17. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed and construed in accordance with the laws of New York State, USA. All other store’s Terms of Service will be governed by the State in which they specify.
